Understand the different roles involved in bringing products into the United States.

The importer of record is generally responsible for using reasonable care in customs entry, classification, valuation, origin, admissibility, and payment of duties. A customs broker can prepare and transmit entries, but the importer remains responsible for the accuracy of the information provided.


A U.S. regulatory responsible party may be a different role. FCC SDoC, FDA programs, marketplace requirements, and state laws can each define responsible-party or agent obligations differently.


Chinese manufacturers should avoid treating every U.S. contact as interchangeable. The commercial importer, customs broker, distributor, U.S. agent, FCC responsible party, and marketplace account holder may be separate entities with distinct responsibilities.


Roles should be documented in contracts and project records before shipment so that compliance notices, entry questions, recalls, or regulator inquiries reach the correct party.
